Terms & Conditions
1. Identity
Hans Vandenberghe Executive Coaching & Leadership Development is a brand of Hanzibar BV, registered in Belgium, with registered offices at Zandpoortstraat 25, 9000 Ghent, Belgium.
The company is represented by its director, Hans Vandenberghe, hereafter referred to as the Coach.
2. Nature of the Work
The work offered by Hans Vandenberghe consists of professional coaching and leadership development conversations, conducted in a private, one-to-one or small group context.
The precise scope, themes and forms of this work are not standardised and may evolve over time. Any engagement is defined through direct agreement between the Client and the Coach.
The work is conversational in nature and is intended to support reflection, responsibility and decision-making in professional and personal contexts.
3. Responsibility
The Client remains fully responsible for their own physical, mental and emotional wellbeing at all times.
All decisions, actions and outcomes resulting from the work are the sole responsibility of the Client. The Coach does not make decisions on behalf of the Client and does not assume responsibility for the Client’s choices or actions.
The Client may end the engagement at any time.
4. Professional Boundaries
The work offered does not constitute medical, psychological, psychiatric, therapeutic, legal, financial or other regulated professional advice.
Clients are expected to seek appropriate qualified professionals for matters requiring such expertise.
If the Client is currently under the care of a mental health professional, the Client confirms that this professional has been informed of the Client’s decision to engage in coaching conversations.
5. Language
The work is conducted primarily in English. In some cases, sessions may be conducted in Dutch by mutual agreement.
The Client acknowledges that English may not be their first language and accepts responsibility for communicating any limitations or concerns related to language comprehension.
6. Sessions and Time
Sessions are typically scheduled for approximately one hour. Sessions may end earlier or continue longer depending on the flow of the conversation.
If a session extends beyond ninety minutes, any additional time is discussed during the session and continues only with the Client’s explicit agreement.
7. Confidentiality
All information shared during the work is treated as confidential.
Confidentiality may only be broken where legally required or where there is a clear and immediate risk of serious harm.
The Coach may, on an anonymous and non-identifiable basis, reflect on aspects of the work with other professional coaches for supervision or professional development purposes.
8. Intellectual Property
All written materials, concepts, texts and frameworks shared by the Coach remain the intellectual property of Hans Vandenberghe / Hanzibar BV, unless explicitly agreed otherwise in writing.
These materials may not be reproduced, distributed or used for commercial purposes without prior written consent.
9. Fees and Invoicing
Fees for the work are agreed in advance.
Invoices are payable prior to the start of the engagement or as otherwise agreed in writing. Sessions are scheduled once payment has been received.
10. Refund Policy
Fees already paid are non-refundable.
Any prepaid sessions or engagements that have not yet taken place are forfeited upon termination, unless explicitly agreed otherwise in writing.
11. Cancellation
Scheduled sessions may be cancelled or rescheduled up to 24 hours in advance.
Sessions cancelled within 24 hours of the scheduled time are not refunded or credited.
12. Practical Arrangements
Remote sessions take place via video conferencing software.
For in-person sessions, the Client is responsible for any travel, accommodation or related expenses unless explicitly agreed otherwise.
13. Communication
Any communication outside scheduled sessions takes place by mutual agreement. This may include email or messaging, depending on the nature of the engagement.
14. Liability
The Client acknowledges that coaching is a reflective and developmental process that may involve challenging conversations.
To the fullest extent permitted by law, Hans Vandenberghe Coaching & Training is not liable for any loss, damage or consequences arising from decisions or actions taken by the Client.
Liability is only accepted in cases of proven intentional misconduct.
15. Ethics
Hans Vandenberghe adheres to the Code of Ethics of the International Coaching Federation (ICF).
Hans Vandenberghe is an ICF member and has been accredited as a Professional Certified Coach (PCC).
16. Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions remain fully effective.
17. Governing Law
These Terms & Conditions are governed by Belgian law.
